Terms of Use

These terms govern your use of marque.cars(the "Service"), operated by Holted Holdings ("Marque", "we", "us"). By accessing or using the Service you agree to be bound by these terms. If you do not agree, do not use the Service.

Marque is a data and research platform that aggregates and publishes price information for collectible cars. It is not: a regulated financial product, a dealer, an auction house, an inspector, a finance broker, or an investment adviser. We do not buy, sell, or hold cars on your behalf.

Information on the Service is provided for general interest and research only. It is not personal financial, investment, tax, or legal advice. Take qualified professional advice before committing capital to any car purchase.

You must be at least 18 years old and able to enter a binding contract under the laws of your jurisdiction to create an account or purchase a subscription.

When you create an account, you are responsible for keeping your credentials secure and for all activity that happens under it. Tell us at justin@marque.cars immediately if you suspect unauthorised access.

We use Clerk to handle authentication, including Sign in with Google. By signing in you also agree to Clerk's terms.

You agree not to:

• Scrape, crawl, or systematically download the Service, including the model index, sales data, or any aggregated content, except via channels we provide (e.g. RSS, a sanctioned API).
• Resell, sublicense, or commercially redistribute the data without a written licence from us.
• Reverse-engineer, decompile, or attempt to derive the source code of the Service.
• Impersonate any person, misrepresent your affiliation, or submit false information in any form (Concierge, lead-gen, valuations).
• Use the Service to harass, defraud, or harm any person.
• Bypass any security, rate-limit, or access-control mechanism.
• Upload, post, or transmit any code, virus, worm, or material that interferes with the Service or other users.

We may suspend or terminate access without notice if we reasonably believe you have breached these rules.

Marque aggregates data from third-party sources including public auction results, listing marketplaces, and partner APIs. We present this information on a best-efforts basis. We do not warrant that any specific price, sale, listing, or valuation is accurate, complete, current, or fit for any particular purpose.

Median prices, year-on-year changes, signals, and forecasts are statistical estimates derived from samples and modelling. They can and do move; past performance is not a reliable indicator of future value.

The Value My Cartool, the Top 50 PDF, and parts of the Journal use large language models to write commentary and synthesise comparables. These outputs are generated automatically. We've designed the prompts to be conservative and grounded in real comparables, but AI can still produce errors. Treat AI-generated text as a starting point for your own research, not as the last word.

Most of Marque is free to use. The Concierge tier is a paid subscription:

• Price: US$299 per year (or local-currency equivalent at checkout). Auto-renews on the anniversary unless cancelled.
• Billing: processed by Stripe. We never store your full card details.
• Cancellation: cancel any time from your account or by emailing us. Cancellation takes effect at the end of the current billing period.
• Refunds: UK and EU consumers have a statutory 14-day cooling-off right (refunded in full if you have not yet made substantive use of the Concierge service). Outside that, subscription fees are non-refundable mid-period.
• Price changes: we may change the Concierge price for new sign-ups at any time. Existing subscribers will be notified at least 30 days before any renewal at a new rate.

Until we explicitly launch Concierge payments, all sign-up forms are email-capture only — no card is requested and nothing is billed.

The Marque name, wordmark, design system, the canonical model graph, the aggregated index, and the original editorial content are owned by Holted Holdings and protected by copyright and trademark law.

Underlying auction lots, listings, and photographs remain the property of their respective sources (Bring a Trailer, Bonhams, Iconic Auctioneers, eBay, Carsales, etc.). We display them under fair-use / public-record principles and link back to the original where possible.

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Nothing on the Service constitutes a recommendation to buy, sell, hold, finance, or insure any vehicle. Collectible cars are illiquid, condition-dependent physical assets with material transaction and carrying costs. Do your own due diligence — inspect the car, check the history, take professional advice.

To the maximum extent permitted by law, Marque shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, business, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability for any direct loss arising from these terms or the Service, in any 12-month period, is limited to the greater of £100 or the amount you actually paid us in that period.

Nothing in these terms excludes or limits our liability for fraud, fraudulent misrepresentation, death, personal injury caused by negligence, or any other liability that cannot be excluded by law.

You may stop using the Service at any time and close your account by emailing us. We may suspend or terminate your access if you breach these terms, abuse the Service, or for legal reasons. Provisions that by their nature should survive termination (intellectual property, disclaimers, liability, governing law) will survive.

We may update these terms from time to time. The "Last updated" date at the top shows the latest revision. For material changes we'll surface a notice on the Service or email account holders before the change takes effect. Continued use after the change means you accept the updated terms.

• If you are based in the United Kingdom or the European Union, these terms are governed by the laws of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction.
• If you are based in Australia, these terms are governed by the laws of New South Wales, and the courts of New South Wales have non-exclusive jurisdiction.
• Otherwise, the laws of England and Wales apply.

Nothing in this clause limits any non-waivable consumer rights you have under your local law.
